3. Use of Website and Services

3.1 Account Registration

Some areas of our website may require registration. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 User Conduct

  • Comply with all applicable laws and regulations
  • Respect the rights of other users
  • Not use our services for any illegal or unauthorized purpose
  • Not attempt to gain unauthorized access to any portion of the website or services

4. Course Registration and Payment

4.1 Booking Confirmation

Your place in a course is only confirmed after we have received full payment and sent you a booking confirmation email.

4.2 Payment Terms

All prices are in Australian Dollars (AUD) and include GST. Payment must be made in full at the time of booking unless otherwise agreed in writing.

4.3 Cancellation Policy

If you need to cancel your enrollment in a course:

  • Cancellations made more than 21 days before the course start date will receive a full refund less a $50 administrative fee.
  • Cancellations made between 14 and 21 days before the course start date will receive a 50% refund.
  • Cancellations made less than 14 days before the course start date are non-refundable.

You may transfer your enrollment to another person or to a future course date at least 7 days prior to the course start date at no additional cost.

4.4 Course Cancellation by SpeakUp Australia

We reserve the right to cancel or reschedule courses due to insufficient enrollment, instructor illness, or other unforeseen circumstances. In the event of cancellation, we will offer you a full refund or the option to transfer to another course date.

5. Intellectual Property

All content, materials, and resources provided through our website and services, including but not limited to text, graphics, logos, images, audio, video, and software, are the property of SpeakUp Australia or our content suppliers and are protected by Australian and international copyright, trademark, and other intellectual property laws.

5.1 Use Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any of the materials on our website except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

TO THE FULLEST EXTENT PERMITTED BY LAW, SPEAKUP AUSTRALIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event will our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to SpeakUp Australia in the last six months, or $100 if you have not made any purchases through the website or services.

8. Indemnification

You agree to defend, indemnify, and hold harmless SpeakUp Australia, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the website or services.

9. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the website or services following the posting of revised Terms means that you accept and agree to the changes.
